- 2 <br /> <br />3) No person shall, for any purpose whatsoever, break-up, alter <br /> <br />or remove any earth, gravel, or any portion of any curb, sidewalk, <br />shoulder or any surface of any public highway without first obtaining <br />the written perm~ssion of the Engineer to do so. <br /> <br />4) Any person applying for the written permission of the Engineer <br /> <br />under Section 2 and 3 hereto, shall complete the necessary form <br />prescribed by the off~ce of the Engineer from time to time and the <br />written permission of the Engineer shall be properly evidenced by a <br />permit under his signmture or other authorized officer, the form of which <br />shall be determined by the Engineer. <br /> <br />5) Any person who breaks up or removes or causes the breaking up or <br /> <br />removing of any earth, gravel, or any portion of any curb, sidewalk, <br />shoulder or surface of any public highway under the authority of a permit <br />issued under this By-law shall: <br /> <br /> a) Exercise all possible precaution against injury to persons or <br />property resulting from such work. <br /> <br /> b) Leave no trenches, pits, holes or excavations uncovered, without <br />providing sufficient protection at all times. <br /> <br /> c) Install, erect and provide barricades, signs, traffic cones, <br />flashers, lights, plates, warning and other devices, materials and personnel <br />in accordance with the provisions required by the Engineer from time to <br />time. <br /> <br /> d) Comply with the requirements of The Construction Safety Act, 1973 <br />and the regulations passed in connection therewith. <br /> <br /> e) Comply with the by-laws, regulations, controls and requirements <br /> <br />of the municipality in which the lands concerned are situate. <br /> <br />6) Any person performing any work under a permit issued under this <br /> <br />by-law shall carefully replace each in its proper order, all earth,:gravel, <br />curb-stone, concrete or paving material of whatever nature or kind, dis- <br />placed or removed under the authority of such permission and shall leave <br />the whole of the same in, at least as good and compact condition as it <br />existed before the commencement of any work so permitted. <br /> <br /> <br />
