BY-LAW NUMBER 2480 A BY-LAW OF THE CORPORATION OF THE COUNTY OF ESSEX TO REGULATE THE LOCATION OF BUILDINGS AND STRUCTURES ON LAND ADJACENT TO COUNTY ROADS. WHEREAS, authority is granted pursuant to The Public Transportation and Highway Improvement Act, R. S. O. 1980, Chapter 419, to regulate the %ocation of buildings and structures on land adjacent to roads under the jurisdiction of the County. AND WHEREAS, it is deemed advisable to so regulate the location of such buildings and structures; THE COUNCIL OE THE CORPORATION OF THE COUNTY OF ESSEX ENACTS AS FOLLOWS: 1. (a) No person shall erect any building or structure, any part of which is located closer to the nearest limit of any of the County roads or parts of the County roads, hereinafter defined, than: 10.7 metres (35 feet) where the road is 30.5 metres (100 feet) wide 12.8 metres (42 feet) where the road is 26.2 metres (86 feet) wide 15.9 metres (52 feet) where the road is 20.1 metres (66 feet) wide within a 15.2 metre x 15.2 metre (50 feet x 50 feet) daylight triangle at road intersections, and in no case closer to the centre line of the original road allowance than 25.9 metres (85 feet) except where there is an open Municipal Drain or Ditch or Water Course Drain, on or adjacent to the road allowance of any road, the dimensions set out above shall, in each instance, be increased by 7.6 metres (25 feet). (b) Provided that in case of two existing buildings either or both or which is, or are, located closer to the nearest limit of any County road hereinafter defined than is permitted in 1 (a) of this by-law, which are less than 91.5 metres (300 feet) apart measured parallel to the centre line of the road, the provisions of this paragraph shall apply to the extent that no person shall erect any building or structure between the aforesaid existing Structures closer to the centre line of the road than the line joining the closest limit point to the centre line of the road of the one structure, to the closest point to the centre line of the road of the next adjacent structure. (c) Provided that in cases where a building exists closer to the nearest limit of any County road hereinafter defined than is permitted in 1 (a) of this by-law, the provisions of this paragraph shall apply so that no person shall erect a building or structure closer to the centre line of the road than the existing building or structure if the distance (measured parallel to the centre line of the road) between the existing and proposed structures is more than 20 feet. No person shall erect or install gasoline pumps: (a) closer than 60 feet from the centre line of the original road allowance, (b) on a curve or crest of a hill, (c) on the tangent to a horizontal or vertical curve where the sight distance is less than 243.9 metres (800 feet) in each direction.
