BY-LAW NUMBER 2449 <br /> <br />A BY-LAW REGULATING HEAVY TRAFFIC <br /> <br /> WHEREAS R.S.O. 1970, Chapter 284 Section 354 (1), paragraph <br />107 empowers local municipalities to prohibit heavy traffic on highways. <br /> <br /> AND WHEREAS The Municipal Amendment Act, 1975, Chapter 56, <br />Section 10 confers upon the Councils of Counties, the exercise of the <br />same powers as in said Section 354 (1). <br /> <br /> AND WHEREAS the Council of The Corporation of the County of <br />Essex deems it advisable to prohibit heavy traffic on the highway here- <br />inafter described. <br /> <br /> NOW THEREFORE the Council of the Corporation of the County of <br />Essex enacts as follows: <br /> <br />In this by-law "heavy traffic" means the use of a highway by <br />a vehicle, object or contrivance for moving loads, having a <br />gross weight, including the vehicle, object or contrivance and <br />load, in excess of twelve (12) tonnes. <br /> <br />When suitable signs have been erected and are on display, <br />heavy traffic is prohibited on the highways or parts of <br />highways named hereunder:- <br /> <br />HIGHWAY FROM TO <br /> <br />County Road 17SA <br /> <br />County Road #42SA <br /> <br />Municipal limits <br />of the City of <br />Windsor <br /> <br />The provisions of this By-law shall not extend to the use of <br />the said highways or part of highways for deliveries to or removals <br />from any premises abutting thereon, to ambulances, to police or <br />fire department vehicles, to public utility emergency vehicles, <br />to vehicles actually engaged in works undertaken for or on behalf <br />of the Corporation, or to a privately-owned vehicle driven to or <br />from the owner's residence. <br /> <br />Any person violating any of the provision of this by-law shall <br />be subject to a panalty of not more than $1,000.00, exclusive <br />of costs, and all such penalties shall be recoverable under <br />the Provincial Offences Act, 1979. <br /> <br />ENACTED AND PASSED this <br /> <br />1st reading-July 15 /81 <br />2nd reading-July 15 /81 <br />3rd reading-July 15 /81 <br /> <br />15th _day of July , 1981. <br /> <br /> <br />
