BY-LAW NUMBER 2447 <br /> <br />A BY-LAW REGULATING HEAVY TRAFFIC <br /> <br />WHEREAS R.S.O. 1970, Chapter 284 Section 354 (1), paragraph <br />107 empowers local municipalities to prohibit heavy traffic <br />on highways. <br /> <br />AND WHEREAS The Municipal Amendment Act, 1975, Chapter 56 <br />Section l0 confers upon the Councils of Counties, the exer- <br />cise of the same powers as in said Section 354 (1). <br /> <br />AND WHEREAS the Council of The Corporation of the County of <br />Essex deems it advisable to prohibit heavy traffic on the <br />highway hereinafter described. <br /> <br /> NOW THEREFORE the Council of The Corporation of the County of <br />Essex enacts as follows: <br /> <br />In this by-law "heavy traffic" means the use of a highway by a <br />vehicle, object or contrivance for moving loads, having a gross <br />weight, including the vehicle, object or contrivance and load, <br />in excess of five (5) tonnes. <br /> <br />When suitable signs have been erected and are on display, heavy <br />traffic is prohibited on the highways or parts of highways named <br />hereunder:- <br /> <br />HIGHWAY FROM TO <br /> <br />County Road 40SA <br /> <br />County Road 3SA <br /> <br />Matchette Road <br /> <br />The provisions of this By-law shall not extend to the use of the <br />said highways or parts of highways for deliveries to or removals <br />from any premises abutting thereon, to ambulances, to police or <br />fire department vehicles, to public utility emergency vehicles, <br />to vehicles actually engaged in works undertaken for or on behalf <br />of the Corporation, or to a privately-owned vehicle driven to or <br />from the owner's residence. <br /> <br />Any person violating any of the provisions of this by-law shall <br />be subject to a penalty of not more than $1,000.00, exclusive <br />of costs, and all such penalties shall be recoverable under the <br />Provincial Offences Act, 1979. <br /> <br />ENACTED AND PASSED this <br /> <br />24th day of June , 1981. <br /> <br />1st. reading -June 24/81 <br />2nd. reading -June 24/81 <br />3rd. reading -June 24/81 <br /> <br /> <br />
