THIS AGHEEMENT made in triplicate this seventeenth day of December, 1979. BETWEEN: HER MAJESTY THE QUEEN, in right of the Province of Ontario, represented by the Minister of Transportation and Communi- cations for the Province of Ontario, hereinafter referred to as "THE MINISTER", OF THE FIRST PART THE CORPORATION OF THE COUNTY OF ESSEX, hereinafter referred to as "THE CORPORATION", OF THE SECOND PART W~EREAS the Minister and the Corporation have agreed on the terms and conditions under which the Minister will transfer cer- tain portions of the King's Highway to the Corporation and will construct certain portions of proposed new King's Highway Number 3; AND WHEREAS the Parties are desirous of recording those terms and conditions. NOW THEREFORE THIS AGRE~TENT WITNESSETH that in considera- tion of the premises and the covenants hereinafter contained, the Minister and the Corporation agree each with the other, as fol- lows: Tho Minister will transfer forthwith to the Corporation, and the Corporation will accept into its road system, that portion of the King's Highway numbered as ?135, shown on Schedule "A" attached hereto as being between points A and E and between points C and D. The said highway will be transferred and accepted in its now existing condition without further improvement by the Minister. (1) The Minister will attend to hot-mix patching of re- quired areas of that portion of existing FAng's Highway Number 3 between points C and F as shown on Schedule "A'. The said hot-mix patching will involve the placing of approximately 2~OO0 tons of material. (2) The Minister will widen by approximately three feet existing King's Highway Number 3, in the hamlet of Cottam, from Victoria Street and extending approxi- mately 1200 feet westerly therefrom. The said widening will be done on the north side of the highway and will include the replacement of existing curb and gutter, the provision of associated sewers and catch basins and pavement widening to the new gutter. The Minister will attend to work on that portion of exis- ting King's Highway Number 3 between points F and G as shown on Schedule "A'~. The said work will be done in accordance with drawings prepared by Todgham ~nd Case Associates Incorporated and bearing number W.P. 611-73-O2.
