BY-LAW NUMBER 2347 <br /> <br />A BY-LAW TO PROVIDE A PI~kN OE SICK LEAVE CREDIT GRATUITIES FOR <br />CERTAIN EMPLOYEES OF THE CORPORATION OF THE COUNTY OF ESSEX. <br /> <br /> WHEREAS, by section 352, paragraph 65 of The Municipal Act, R. S.O., <br />Chapter 280, Councils of municipalities are authorized to draft by-laws to <br />provide a plan of sick leave credit gratuities. <br /> <br /> AND WHEREAS it is deemed advisable and expedient to pass such a <br />By-law to provide sick leave credit gratuities for the employees of the County <br />of Essex. <br /> <br /> NOW THEREFORE be it enacted and it is hereby enacted by the Council <br />of the Corporation of the County of Essex as follows: <br /> <br />1. An accumulated sick leave plan is hereby established for all those <br />full-time employees of the Corporation of the County of Essex that are not <br />covered by any collective agreement in force from time to time. <br /> <br />2. Ail employees of the Corporation having completed their probation- <br />ary period shall be allowed sick leave on the basis of 1~ days for each month <br />of service, commencing from the date of their employment. A doctor's certi- <br />ficate shall be presented to the Administrator of the County by any employee <br />absent from work due to sickness for more than 3 working days. Ail unused <br />sick leave shall be accumulated on a pro rata basis to the nomber of days <br />worked each month and records thereof shall be maintained by the Corporation. <br />Notwithstanding anything therein contained any employee hired by the Corpora- <br />tion after September 12, 1979, shall be allowed to accumulate sick leave as <br />provided herein, but shall only be entitled to use such accumulated credits <br />in the event of illness. No portion whatever of the accumulated sick leave <br />credit will be payable to such an employee notwithstanding the number of <br />years service in the employ of the Corporation. <br /> <br />3. Any employee absent from work through sickness shall not be paid <br />for days absent, save and except, where such employee has accumulated sick <br />leave, in which case such absence shall be deducted from the employee's <br />accumulated sick leave without any deduction in said employee's pay. <br /> <br />4. Any employee receiving monies through Workmen's Compensation Board <br />shall not receive any monies from the Corporation nor experience any deduction <br />in accumulated sick leave. Any employee receiving monies from disability <br />insurance provided by the Corporation of the County of Essex shall deliver <br />such monies to the County Administrator, receive an amount equal to the amount <br />of pay he would receive for a normal work week, and shall have his correspond- <br />ing number of days deducted from his accumulated sick leave. <br /> <br />5. Any employee failing to report to work due to sickness shall notify <br />his immediate supervisor or department head at least 30 minutes after the <br />commencement of his normal work day. <br /> <br />6. Sick leave for each month of service shall be accumulated on a <br />pro-rata basis except in the following circumstances when no sick leave shall <br />be accumulated: <br /> <br />(a) On leave of absence without pay; <br />(b) Lay-off by the Corporation; <br />(c) Suspended for just cause. <br /> <br /> <br />
