THIS AGREEMENT made this i5th day of August , 1979. <br /> <br />BETWEEN: <br /> <br /> THE CORPORATION OF THE COUNTY OF ESSEX, Road Department, <br /> hereinafter referred to as the CORPORATION, <br /> <br /> PARTY OF THE FIRST PART <br /> <br /> TEAMSTERS, CHAUFFEURS, WAREHOUSEMEN AND HELPERS, LOCAL 880 <br /> affiliated with the International Brotherhood of Teamsters, <br /> Chauffeurs, Warehousemen and Helpers of America, <br /> hereinafter called the UNION, <br /> <br /> PARTY OF THE SECOND PART <br /> <br /> WHEREAS the Union has submitted to the Council of the Corporation <br />certain recormnendations respecting employment and working conditions for employees <br />of the Corporation who perform certain services for the Corporation. <br /> <br /> AND WHEREAS the said Council has agreed to accept certain <br />recommendations, and had, by By-law 2343, authorized the execution of this Agreement. <br /> <br /> THEREFORE, this Agreement witnesseth in consideration of the promise <br />and mutual covenants herein contained, the Parties have agreed as follows: <br /> <br />1. RECOGNITION <br /> <br />1.01 The Corporation recognized the Teamsters, Chauffeurs, Warehousemen <br />and Helpers, Local 880, as the exclusive Bargaining Agency for all employees save <br />and except Foremen, those above the rank of Foremen, and Office Staff. <br /> <br />1.02 The Corporation shall discuss with the Union, through its accredited <br />representatives, all matters pertaining to wages, hours of work, seniority, <br />grievances, and other working conditions which may arise between them during the life <br />of the Agreement. <br /> <br />1.03 The Corporation agrees that ali_ employees in the unit who are members <br />of the Union in good standing as of the date hereof, shall remain members of the <br />Union as a condition of continued employment and any such employee who ceases to be <br />a member of the Union, shall, forthwith be discharged by the Corporation, provided, <br />however, that any employee who is not now a member of the Union shall have the <br />privilege of becoming a member, or not, as he may decide. <br /> <br />1.04 All new employees after a period of thirty (30) days will be placed on <br />check-off for the duration of this Agreement, intent being that the Rand Formula <br />shall be applied. <br /> <br />1.05 The Corporation will advise the Union when any additional persons <br />coming within the Bargaining Unit are employed by the Road Department. <br /> <br /> <br />
