A G R E E M E N T made this 5th day of April, 1979. BETWEEN: ROBERT PULLEYBLAfdK, of Oldcastle Ontari County of Essex, carrying on business under the name of "Surburban Landscaping" Hereinafter called the "Company" -and- OF THE FIRST PART THE CORPORATION OF THE COUNTY OF ESSEX Hereinafter called the "Corporation" OF THE SECOND PART WHEREAS the Corporation has requested the tenders for and the Company has submitted a successful tender for the care and maintenance of the grounds owned by The Corporation and known as the Essex County Civic and Education Centre, 360 Fairview Avenue West, in the Town of Essex, in the County of Essex and Province of Ontario. NOW THEREFORE Ifd CONSIDERATION of the covenants, agreements and conditions contained herein, the parties hereto agree as follows: 1. The Corporation agrees to accept the tender of the Company dated the 19th day of March, 1979 to provide for the care and maintenance of the grounds of The Essex County Civic and Education Centre in accordance with the specifications set forth in the tender therefore and which tender is attached hereto as Schedule "A" and forms a part of this Agreement. 2. For the services and materials to be provided by the Company herein pursuant to the specifications contained in the attached Schedule "A", The Corporation shall pay to the Company on the first of each month the billing received for the month immediately prior thereto. 3. This agreement is to continue in force from the 1st day of January, 1979 to and including the 31st day of December, 1980, and the Company covenants and agrees during that period of time to perform to the Corporation's complete satisfaction the service or services required of it, as set forth in this agreement and in general perform the specifications attached hereto.
