E <br />f <br />B E T W E E N- �I <br />i� <br />THE CORPORATION OF THE COUNTY OF ESSE <br />Hereinafter called the "CORPORATION" i <br />OF THE FIRST PART it <br />and - <br />TERRY LINTON LIMITED a company incor- <br />porated under the laws of the Province <br />of Ontario, and having its Head Office <br />in the City of Windsor, County of Essex <br />and Province of Ontario, <br />Hereinafter called the LICENSEE <br />OF THE SECOND PART <br />WHEREAS the Licensee represents and covenants that the Licensee <br />is the owner of ALL and Singular that certain parcel or tract of land and <br />premises, situate, lying and being in the Township of Sandwich West, in <br />the County of Essex and Province of Ontario and being composed of Part of <br />Farm Lot One (1) in.the Third Concession of the said Township which may <br />be more particularly described as follows: COMMENCING at an'iron bar in <br />the westerly limit of Huron Church Road as widened by Instrument Number <br />306836, where the same intersects with the easterly limit of the Road <br />allowance between Concessions, Two (2) and Three (3) sometimes referred to <br />as Disputed ,Road; THENCE South Twenty -five Degrees, Twenty -four Minutes, <br />Twenty Seconds East (S: 25° 24,' E.) One Hundred and Forty -six and Fifty <br />I. <br />One- Hundredths Feet (146.50') to an iron bar; THENCE South Sixty -two <br />Degrees, Forty -three Minutes, Five Seconds West (S. 62° 43' 5" W.), Seventy - <br />nine and Fifty -nine One- Hundredths Feet (79.59') to an iron bar planted <br />in the easterly limit of the said Disputed Road; THENCE North'Two Degrees, (I <br />Forty Minutes and Thirty Seconds East (N. 2° 40' 30" E.) One Hundred and <br />Sixty -Nine feet (169') more or less to the point of commencement. <br />AND WHEREAS a one - storey concrete block building municipally known <br />as 4205 -4209 Huron Church Road, is located on part of the said lands as <br />shown on Drawing No. W74 - L660, dated July 16th., 1974; prepared by <br />Koester &,Verhaegen Limited, Ontario Land Surveyors, a copy of which is <br />hereto attached and marked, Schedule "A" to this Agreement; <br />AND WHEREAS a part of the said building encroaches upon the <br />adjacent public highway and the Licensee has applied for permission to the <br />encroachment for the life of the building upon that part of the said public <br />highway shown on said Schedule "A" and hereinafter referred to as the <br />"encroachment <br />�j <br />ii <br />
