E f B E T W E E N- �I i� THE CORPORATION OF THE COUNTY OF ESSE Hereinafter called the "CORPORATION" i OF THE FIRST PART it and - TERRY LINTON LIMITED a company incor- porated under the laws of the Province of Ontario, and having its Head Office in the City of Windsor, County of Essex and Province of Ontario, Hereinafter called the LICENSEE OF THE SECOND PART WHEREAS the Licensee represents and covenants that the Licensee is the owner of ALL and Singular that certain parcel or tract of land and premises, situate, lying and being in the Township of Sandwich West, in the County of Essex and Province of Ontario and being composed of Part of Farm Lot One (1) in.the Third Concession of the said Township which may be more particularly described as follows: COMMENCING at an'iron bar in the westerly limit of Huron Church Road as widened by Instrument Number 306836, where the same intersects with the easterly limit of the Road allowance between Concessions, Two (2) and Three (3) sometimes referred to as Disputed ,Road; THENCE South Twenty -five Degrees, Twenty -four Minutes, Twenty Seconds East (S: 25° 24,' E.) One Hundred and Forty -six and Fifty I. One- Hundredths Feet (146.50') to an iron bar; THENCE South Sixty -two Degrees, Forty -three Minutes, Five Seconds West (S. 62° 43' 5" W.), Seventy - nine and Fifty -nine One- Hundredths Feet (79.59') to an iron bar planted in the easterly limit of the said Disputed Road; THENCE North'Two Degrees, (I Forty Minutes and Thirty Seconds East (N. 2° 40' 30" E.) One Hundred and Sixty -Nine feet (169') more or less to the point of commencement. AND WHEREAS a one - storey concrete block building municipally known as 4205 -4209 Huron Church Road, is located on part of the said lands as shown on Drawing No. W74 - L660, dated July 16th., 1974; prepared by Koester &,Verhaegen Limited, Ontario Land Surveyors, a copy of which is hereto attached and marked, Schedule "A" to this Agreement; AND WHEREAS a part of the said building encroaches upon the adjacent public highway and the Licensee has applied for permission to the encroachment for the life of the building upon that part of the said public highway shown on said Schedule "A" and hereinafter referred to as the "encroachment �j ii
