THIS AGREEMENT <br /> <br />made this 14th day of December <br /> <br />, A. D. 1977. <br /> <br />BETWEEN: <br /> <br /> THE CORPORATION OF THE COUNTY OF ESSEX, <br /> hereinafter called the CORPORATION, <br /> OF THE FIRST PART, <br /> <br />-and - <br /> <br />THE SUN PARLOR HOME EMPLOYEES, LOCAL UNION ~ER 860, <br />chartered by the CANADIAN UNION OF PUBLIC EI~PLOYEES, AND <br />affiliated with the CANADIAN LABOUR CONGRESS, <br />hereinafter called the UNION, <br /> OF THE SECOND PART <br /> <br />WHEREAS it is the desire of both parties to this Agreement: <br /> <br />(a) To maintain the existing harmonious relations and settle <br />conditions of employment between the Corporation and the Union; <br /> <br />(b) To encourage efficiency in operation; <br /> <br />(e) To promote the morale, well-being and security of all the <br />employees in the Bargaining Unit of the Union. <br /> <br /> AND WHEREAS it is now desirable that methods of bargaining <br />and all matters pertaining to the working conditions of the employees be <br />drawn up in an Agreement. <br /> <br /> ,~ NOW THEREFORE, the Parties agree as follows: <br /> <br /> 1. MANAGEMENT RIGHTS <br /> <br />1.01 The Union recognizes the Corporation as a non-profit Corpora- <br />tion which is supported by monies raised through taxes. <br /> <br />1.02 The Union acknowledges that it is the right of the Corporation <br />to hire, promote, demote, transfer, suspend, or otherwise discipline and <br />discharge an employee for proper cause, provided that procedure contrary to <br />this agreement are not used and the right of the Union and/or employee to <br />lodge a grievance to the manner and extent herein provided be dealt with <br />in accordance with the grievance procedure hereinafter detailed. <br /> <br />1.03 The Union recognizes the right of the Corporation to operate <br />and manage the said Senior Citizen's Home in accordance with its obliga- <br />tions and in the interest of the residents thereof, and to the community at <br />large and to make and alter from time to time rules and regulations to be <br />obeyed by the employee, which rules and regulations shall not be inconsistent <br />with the provisions of this Agreement. Such rules and regulations and <br />any changes therein from time to time shall not be enforced by the Corpora- <br />tion until they have been posted on the bulletin board normally used for this <br />purpose for a period of at least one week. <br /> <br />2. RECOGNITION AND NEGOTIATIONS <br /> <br />2.01 The Corporation, or anyone authorized to act on its behalf <br />approves and recognizes the Sun Parlor Home Employees' Local Union 860 <br />as the exclusive bargaining agent for all its employees save and except <br />Department Heads, Office Staff and Registered Nurses, and hereby consents and <br />agrees to negotiate with the Union, looking towards a peaceful and amicable <br />settlement of any difference that may arise between them. <br /> <br />2.02 No employee shall be required to be permitted to make any <br />written or verbal agreement which may conflict with the terms of this contract. <br /> <br />2.03 In respect of employees covered by this Agreement, the <br />Corporation shall not recognize during the currency of this Agreement any <br />other Bargaining agent in respect of any matters herein dealt with. <br /> <br /> <br />
