~II~ ~a~ ~n~ ~ ~olll the said demised premises for and g the term of Three (3) <br /> <br /> years <br /> to be computed from the 1st day of November one thousand <br /> nine hundred and s ye -seven and thenceforth next ensuing, and <br />fully to be complete a~ e~r~te~ on the thirty-first day of October in each, or <br />date which the crop is fully harvested in that year, whichever date comes the <br />YIELDING AND PAYING therefor yearly and every year during the said term hereby <br />granted unto the Lessor the sum of seventy-one dollars ($71.00) <br />xl~attm~of lawful <br />money of Canada, without any deduction, defalcation or abatement whatsoever to be <br /> payable on the following days and times, that is to say: <br /> <br /> the sum of seventy-one dollars ($71.00) per acre per year in advance <br /> <br />that <br />latter. <br /> <br />THE first of such payments to become due and be made on the 1st day of <br />November, in each respective year, during the term of the this Lease <br /> <br />THE Lessee COVENANTS with the Lessor to pay rent. <br />AND to pay taxes, except for local improvements. <br />AND to repair, reasonable wear and tear and damage by fire, lightning and tempest only <br />excepted. <br />AND to keep up fences. <br />AND to perform all statute labour. <br />AND not to cut down timber or trees of any kind whatsoever, except <br /> <br />AND that the Lessor may enter and view state of repair. <br />AND that the Lessee will repair according to notice in writing, reasonable wear and tear, <br />and damage by fire, lightning and tempest only excepted. <br />AND will not assign or sub-let without leave; and such consent may, notwithstanding any <br />section of the Landlord and Tenant Act of the Province of Ontario, be arbitrarily refused <br />by the Lessor in his sole and uncontrolled discretion. <br />AND will not carry on any business that shall be deemed a nuisance on said premises. <br />AND that he will leave the premises in good repair (reasonable wear and tear and damage <br />by fire, lightning and tempest only excepted). <br /> <br />PROVIDED that the Lessee may remove his fixtures, if such removal may be and is done <br />without injury to the said premises. <br />PROVIDED that in the event of damage by fire, lightning or tempest, rent shall cease until <br />the premises are rebuilt. <br /> <br />THE LESSEE hereby covenants and agrees with the Lessor, that in consideration of the <br />premises, and of the leasing and letting by the Lessor to the Lessee of the lands and <br />premises above named for the term hereby created (and it is upon that express under- <br />standing that these presents are entered into), that notwithstanding anything contained <br />in the Landlord and Tenant Act of the Province of Ontario, or any other Statute which <br />may hereafter be passed to take the place of said Act or to amend the same, that none of <br />the goods or chattels of the Lessee at any time during the continuance of the term hereby <br />created, on said demised premises, shall be exempt from levy by distress for rent in arrear <br />by the Lessee as provided for by section or sections of the said Act above named, or any <br />amendment or amendments thereto, and that upon any claim being made for such exemp- <br />tion by the Lessee or on distress being made by the Lessor this covenant and agreement <br />may be pleaded as an estoppel against the Lessee in any action brought to test the right <br />to the levying upon any such goods as are named as exempted in the said Act, or amend- <br />ment or amendments, thereto. Said Lessee waiving, as he hereby does all and every benefit <br />that could or might have accrued to him under and by virtue of the said Act, or any <br />amendment or amendments thereto, but for the above Covenant. <br /> <br />AND the Lessee doth hereby further covenant and agree with the Lessor in manner follow- <br />ing, that is to say: THAT the Lessee will during the said term, cultivate, till, manure and <br />employ such parts of the said premises as are now or shall hereafter be brought under <br />cultivation in a good farmer-like and proper manner, and will in like manner crop the same <br />in a regular rotation of crops so as not to impoverish, depreciate or injure the soil, and will <br />plough the lands in each year during the said term, and at the end of the said term will <br />leave the said land so manured as aforesaid. AND will during the continuance of said term, <br />mow the grass along the fences and in the fence corners on the said lands, keep down all <br />noxious weeds and grasses, and will pull up or otherwise destroy all docks, red roots, wild <br />mustard, wild oats, twitch grass, ox-eye daisy, bind weed, bladder campion, dodder, sow <br />thistle, wild carrot, chicory, common milkweed, white cockle, or Canada thistles, which <br />shall grow upon the said premises or on the side of the roads or highways adjacent thereto, <br />and will not sow er permit to be sown any grain infected by smut or containing any of the <br />noxious weeds or grasses above mentioned, and will not suffer or permit any such foul <br />weeds or grasses to go to seed on the said premises. And will spend, use or employ in a <br />proper farmer-like manner all the straw and manure which shall grow, aris.e, renew or be <br />made thereupon, and will not remove or permit to be moved from said premises any straw <br />of any kind, manure, wood or stone, and will carefully stack the straw in the last year of <br />said term, and will each and every year of said term, turn all the manure thereon into a <br />pile, so that it may thoroughly heat, and rot, so as to kill and destroy any foul seeds that <br />may be therein, and will thereafter and not before spread the same on the land. <br /> <br /> <br />
