May, 1974. <br /> <br />BETWEEN : <br /> <br />THIS AGREEMENT made in duplicate this <br /> <br />THE CORPORATION OF THE TOWN OF ESSEX, <br /> <br />Hereinafter called the TOWN <br /> <br />OF THE FIRST PART: <br /> <br />15th day of <br /> <br />-and- <br /> <br /> THE CORPORATION OF THE COUNTY OF ESSEX, <br /> <br /> HERINAFTER called the COUNTY <br /> <br /> OF THE SECOND PART: <br /> <br /> WHEREAS the County has acquired a thirty-five (35) <br />acre parcel of land situate immediately North of the Essex Bypass and East <br />of Fairview Avenue, being composed of Part of the South half of Farm Lot 281, <br />South of the Talbot Road, in the Town of Essex, in the County of Essex and <br />Province of Ontario designated as Part 1 on a Reference Plan deposited in the <br />Registry Division of Essex (No.12) on July 5, 1973 as No. 12R-884. <br /> <br /> AND WHEREAS the County is in need of sanitary sewer <br /> <br />and water services. <br /> <br /> AND WHEREAS the Town has entered into a subdivision <br />agreement dated the 7th day of May, 1974 with Traders Developments <br />(Windsor) Limited (hereinafter referred to as Traders) for the construction <br />and installation of a sanitary sewer and water line which will end at the <br />intersection of the Easterly limit of Fairview Avenue and Michael Drive as <br />shown on a plan of survey dated May 14th, 1973 prepared by LaFontaine, Cowie, <br />Buratto and Associates Limited, Consulting Engineers, Windsor, Ontario. <br /> <br /> AND WHEREAS the Town has agreed to accommodate the <br /> requirements of the County for sanitary sewer and water services by entering <br /> into an agreement with Traders for the oversizing of the said services. <br /> <br /> NOW THEREFORE in consideration of the premises and <br /> other good and valuable consideration and the sum of FIVE DOLLARS ($5.00) <br /> (the receipt whereof is hereby acknowledged) the parties hereto mutually <br /> covenant and agree as follows: <br /> <br />1. The Town shall enter into a subdivision agreement <br /> <br /> with Traders for the servicing of a parcel of land containing approximately <br /> Thirty-five (35) acres being Part of Block A, Plan 1322, Part of Lot 282, <br /> <br /> <br />
