BY -LAW NUMBER 208y A BY -LAW TO APPORTION THE COUNTY LEVY FOR 1974 AMONG THE SEVERAL CONSTITUENT MUNICIPALITIES IN THE COUNTY OF ESSEX. WHEREAS Section 72 of the Assessment Act, R. S. 0. 1970, Chapter 32 and amendments thereto, requires that the apportionment of the County levy for the following year be set before the first day of October in each year; AND WHEREAS this Council has determined that the informa- tion required to properly apportion the 1974 County levy will not be available until January, 1974; AND WHEREAS Section 72 (5) of the Assessment Act, R.S.O. 1970, Chapter 32 and amendments thereto, authorizes a Council of a County to make an apportionment which it determines is just and equit- able; AND WHEREAS the Council of the County of Essex has determined that a calculation based on up -to -date assessments and grant data would be just and equitable; NOW THEREFORE the Municipal Council of the Corporation of the County of Essex hereby enacts as follows: i! !I E' (1) That the apportionment of the 1974 levy of the County of Essex shall be determined prior to March 1st, 1974 and the method of determining said apportionment shall be calculated as follows: (a) The 1973 final apportionment shall be the base apportion- ment and shall be adjusted by the following calculations: (i) the increase or decrease in actual assessment (assessment returned January 1, 1973 less assessment returned January 1, 1972. (Section 72 of the Assessment Act, R. S. 0. 1970, Chapter 32 and amend- ments thereto.) (ii) the increase or decrease in equivalent assessment of grants in lieu paid to local municipalities (1973 grants in lieu less 1971 grants in lieu) Section 72(3) of the Assessment Act, R. S. 0. 1970,Chapter r 32 and amendments thereto. (iii) the increase or decrease in equivalent assessment of grants paid on behalf of Provincial Parks (1973 grant less 1972 grant) Section 4(a), The Provincial Parks Municipal Tax Assistance Act,1971. (iv) the increase or decrease in equivalent assessment of grants paid on behalf of Universities, Community Colleges, Hospitals and Correctional Institutions (1973 grants less the grant used in calculating the 1973 final apportionment in l(a).Section 4 of An Act to Amend the Municipal Act, 1973 (Bill 168). (v) the increase or decrease in equivalent assessment of taxes allocated to telephone companies (1973 taxes less the taxes used in calculating the 1973 final apportionment in l(a).Section 5 of An Act to Amend the Municipal Act 1973 (Bill 168). (vi) the increase or decrease in equivalent assessment of payments allocated under the Provincial Resource Equalization Grants (1973 grant less the grant used in calculating the 1973 final apportionment in 1(a).
