CORPORATION OF THE COUNTY OF ESSEX <br />BY —LAW NUMBER 2021 <br />A BY —LAW TO ESTABLISH THE DISTRIBUTION OF REPRESENTATION <br />ON THE ESSEX COUNTY BOARD OF EDUCATION TO THE COUNTY MUNICI— <br />PALITIES AND THE SEPARATE SCHOOL SUPPORTERS THEREOF. <br />WHEREAS the Secondary Schools and Boards of Education <br />Act, R. S. 0. 1970, Chapter 425, as amended, provides in Section 38, <br />subsection 10, that the Council of the County shall determine, before <br />the first day of September, 1972, the County municipalities to be <br />represented by each member to be elected in the school division by the <br />Separate School Supporters under Subsection 5, namely six members, but <br />in no case shall the determination provide for a member to be elected <br />by a general vote of all the separate school supporters of the County. <br />AND WHEREAS under subsection 10 in determining under <br />Subsection 9; <br />(a) the number of members to be elected by the Separate <br />School Supports of a county municipality; or <br />(b) the county municipalities that are to be combined <br />for the election of one or more members by the Separate School supporters <br />of such municipalities, the Council of the County shall apportion the <br />number of members determined under subsection 5, namely six members as <br />nearly as is practicable, in the proportion that equalized residential <br />and farm assessment of the property rateable for separate school supporters <br />in the municipality or combined municipalities bears to the total equalized <br />residential and farm assessment of the property rateable for separate school <br />purposes in all the county municipalities in the school division and shall, <br />insofar as is practicable to do so, combine municipalities that are adjoin— <br />ing. <br />as follows: <br />NOW THEREFORE the Council of the County of Essex enacts <br />1. That the municipalities of the County shall, in com— <br />pliance with the terms of the act, summarized in the preamble, be combined <br />into five groups for the purpose of electing six members to the Essex <br />County Board of Education. <br />2. That the County municipalities of the Towns of Amherstburg, <br />and Harrow and the Townships of Anderdon, Malden„ and Colchester South,having <br />in 1972 combined equalized separate school assessment, as defined in the Act <br />of $42,653,080.00 shall together elect one member. <br />3. That the County municipalities of the Town of Tecumseh, <br />Village of St. Clair Beach, and the Townships of Sandwich West, Sandwich <br />South, and Colchester North, having in 1972 combined equalized separate <br />school assessment, as defined in the Act, of $82,112,352.00, shall elect <br />together two members. <br />4. That the County municipalities of the Towns of Belle <br />River and Essex, and the Townships of Maidstone and Gosfield North, having <br />in 1972 combined equalized separate school assessment, as defined in the <br />Act, of $40,856,678.00, shall together elect one member. <br />5. That the County municipalities of the Townships of <br />Rochester, Tilbury North and Tilbury West, having in 1972 combined equalized <br />separate school assessment as defined in the Act, of $41,549,705.00,shall <br />together elect one member. <br />6. That the County municipalities of the Towns of Leamington <br />and Kingsville, and the Townships of Mersea, Gosfield South and Pelee, having <br />in 1972 combined equalized separate school assessment, as defined in the <br />Act, of $41,406,522.00, shall together elect one member. <br />7. That this determination shall be effective subject to the <br />the provisions of subsection (7) and (9) of the Act, for a period of four years. <br />
