BY -LAW NUMBER 71 -38 <br />THE CORPORATION OF THE TOWNSHIP OF SANDWICH SOUTH <br />WHEREAS Section 459 of The Municipal Act empowers <br />Councils of local municipalities to enact by -laws for stopping <br />up highways or parts of highways and selling the same. <br />AND WHEREAS Section 462 of The Municipal Act <br />provides that before the Council of a local municipality shall enact <br />a by -law for the foregoing purposes, notice of the said by -law <br />shall be given by publication once a week for four successive <br />weeks and in respect of Townships having a population of less <br />than Forty Thousand (40,000) by posting up such notice in six (6) <br />of the most prominent places in the area of the highway being <br />so stopped up and sold as aforesaid. <br />AND WHEREAS the Council of the Corporation of the <br />Township of Sandwich South deeming it expedient to stop up <br />the part of the highway hereinafter described, authorized <br />publication of notice of their intention to do so and notice <br />of the intention of Council to enact this by -law was given <br />publication in The Windsor Star, a newspaper having daily <br />general circulation in the Township of Sandwich South, once <br />a week for four successive weeks, namely August 21st, 1971, <br />August 28th, 1971, September 4th, 1971 and September 11th, 1971, <br />and was likewise posted up by way of publication by the Clerk- <br />Treasurer in six (6) of the most prominent places in the area <br />of the highway hereinafter described for a period of one month <br />commencing August 21st, 1971, and ending September 12th, 1971. <br />AND WHEREAS no person has made any claim that his <br />land will be prejudicially affected by the enactment of the <br />said by -law and there has been no objection filed to the <br />enactment of such by-law and the Council of the Corporation <br />of the Township of Sandwich South therefore deems it expedient <br />to enact this by -law. <br />
