BY -LAW NUMBER 1940 A BY -LAW OF THE CORPORATION OF THE COUNTY OF ESSEX TO APPOINT A COUNTY ENGINEER AND ROAD SUPERINTENDENT FOR THE COUNTY OF ESSEX AND SETTING THE SALARY AND ALLOWANCES FOR THE SAID POSITIONS AND TO REPEAL ALL OTHER BY -LAWS INCONSISTENT TO THIS BY -LAW. WHEREAS, it is deemed to be more satisfactory to all parties concerned that a By -law be passed for the purpose as aforementioned. AND WHEREAS it is desirable that the laying out and supervision of all work and expenditures upon improvement and maintenance of roads with- in the jurisdiction of this Council should be under the supervision of a County Engineer and Road Superintendent acting under its direction; AND WHEREAS it is the desire of the Council to take advantage of The Highway Improvement Act and to receive the Government grant as provided in the said Act. BE IT THEREFORE ENACTED by the Council of the Municipal Corpora- tion of the said County and it is hereby enacted: 1. That Roy Robert Lee of the Town of Leamington, Ontario is appointed County Engineer and Road Superintendent in the said County to act as aforesaid in accordance with the provisions of the said Act from the 10th day of November, 1958, and during the pleasure of the said Council. 2. That the said County Engineer and Road Superintendent shall be paid at the rate of Twenty -One Thousand, Seven Hundred and Ninety -Three Dollars ($21,793.00) per annum for such time as he may be so employed, payable bi- weekly as of January 1, 1971. 3. That the said County Engineer and Road Superintendent shall provide his motor car and shall provide for the cost and operation of the said motor car, and when used on County Business shall be paid at the rate:- 1st 7,000 miles at thirteen cents (13¢) per mile 2nd 7,000 miles at eight cents (080) per mile add. 6,000 miles at seven cents (07¢) per mile necessarily travelled in the performance of the duties of his office as County Engineer and Road Superintendent. 4. That the said County Engineer and Road Superintendent be permitted to work for the Windsor Suburban Roads Commission, with approval of the County Road Committee, the remuneration for such work to be paid to the Corporation of the County of Essex and credited to the County Road System account. 5. That it shall be the duty of the County Engineer and Road Superintendent to lay out and supervise all work and expenditure on roads within the jurisdiction of this County Council in accordance )pith the pro- visions of The Highway Improvement Act. 6. That all By -laws or part thereof and�'all And.anx? resolutions of said Council contrary hereto or inconsistent here" ith_ "be',and..tbe same are hereby repealed. 7. That two certified copies of this By-'.law be f6tw4rded by the Clerk without delay to the District Office of the Municipal Roads Branch, Department of Highways. 8. That this By -law shall not come into force and effect until approved by the Minister of Highways as provided in the Highway Improvement Act.
