BY-LAW NL%IBER 1826 <br /> <br />A BY-LAW OF THE CORPORATION OF THE COUNTY OF <br />ESSEX TO REGULATE THE LOCATION OF BUILDINGS <br />AND STRUCTURES ON LAND ADJACENT TO COUNTY ROADS. <br /> <br />PASSED the 4th day of June , 1969. <br /> <br /> ~THEREAS~ it is deemed advisable to regulate <br />the location of buildings and structures on land adjacent <br />to certain County roads; <br /> <br /> AND WHEREAS, authority is granted under <br />Section 64 (1) of The Highway Improvement Act, R.S.O. <br />1960, and Section 30 of The Planning Act, R. $. O. 1960, <br />to exercise such power subject to the approval of the <br />Ontario Municipal Board; <br /> <br /> The Council of the Corporation of the County <br />of Essex enacts as follows: <br /> <br />1. (a) No person shall erect any building or <br />structure, any part of which is located located closer to <br />the nearest limit of any of the County roads or parts of <br />the County roads, hereinafter defined~ than: <br /> <br />35 feet where <br />42 feet where <br />52 feet where <br /> <br />the road is 100 feet wi~e <br />the road is 86 feet wide <br />the road is 66 feet wide <br /> <br />and in no case closer to vhe centre line of the original <br />road allowance than 85 feet~ except where there is a <br />Municipal Drain or Ditch and Watercourse Drain~ on the <br />road allowance of any road, the dimensions set out above <br />shall, in each instance, be increased by 25 feet. <br /> <br /> (b) Provided that in case of two existing <br />buildings either or both of which~is, or are, located <br />closer to the nearest limit ofany County road hereinafter <br />defined than is permitted in 1 (a) of this by-law~ which <br />are less than 300 feet apart measured parallel to the <br />centre line of the road, the provisions of this paragraph <br />shall apply to the extent that no person shall erect any <br />building or strucutre between the aforesaid existing <br />structure closer to the centre line of the road than the <br />line joining the closest limit point to the centre line <br />of the road of the one structure, to the closest point to <br />the centre line of the road of the next adjacent structure. <br /> <br /> (c) Provided that in cases where a building <br />exists closer to the nearest limit of any County road <br />hereinafter defined than is permitted in 1 (a) of this <br />by-law, the provisions of this paragraph shall apply so <br />that no person shall erect a building or structure closer <br />to the centre line or the road than the existing building <br />or structure if the distance (measured parallel to the <br />centre line of the road) between the existing and proposed <br />structures is more than 20 feet. <br /> <br />pumps: <br /> <br />of the <br /> <br /> No person shall erect or install gasoline <br /> <br /> (a) Closer than 60 feet from the centre line <br />original road allowance, <br /> <br />(b) on a curve or crest of a hill, <br /> <br /> (c) on the tangent to a horizontal or vertical <br />curve where the sight distance is less than 800 feet in <br />each direction. <br /> <br />3. The County roads or parts of County roads <br />defined by this by-law are as follows: <br /> <br /> The entire county road system as designed in <br />By-law Number 1658 of the Corporation of the County of <br />Essex, save and ~xcept parts of the County road system; <br />which lie within the limits of any Town,Village or Police <br /> <br /> <br />
