r <br />i <br />2 BY -sews of Txa covxT7r OF assaZ. <br />BY -LAW Noe, la. — - -- <br />(Present No. 2,) <br />To authorise tha acquirement of certain land along the Town Line bettvan enlrhex. <br />ter and Malden, for the uu of the Public Highway, and for repealing rettaiR <br />other by-laws. <br />I. Be it enacted by the Municipal Council of the County of <br />Essex, in Council assembled, under and by virtue of the 6'Cpper <br />Canada Municipal Corporations Act of- 18499" That subject to the <br />conditions hereinafter expressed, Cornelius R. (quick and Henn <br />Wright, Esqs., members of the said Municipal Council, be Commis <br />sioners in the name of and on behalf of the sail Municipal Council <br />to take a deed of conveyance in fee simple of such parcel or parcels <br />of land lying and being along the Town Line between the Town. <br />ships of Colchester and Malden, as may be necessary or required for <br />completing the opening of the Town Line Road between the said <br />Townships, according to the survey of Philo A Salter, Esq., and <br />directed by By -law of this Council numbered six, passed June l: <br />1854, and to do all things expedient or necessary for procuring the <br />complete opening of the said road. <br />II. That the said Commissioners are hereby authorized and em. <br />powered to enter into a negotiation with the parties owning lank <br />along the said lines necessary to be acquired for the purpo afore <br />said, for the purchase thereof, and to give therefor an amount net <br />exceeding five pounds currency per acre, and to sign, seal and deliver <br />any agreement or contract on behalf of the said County Council, <br />which may be needful or necessary to make such agreement or Coe <br />tract binding on behalf of the said County Council. <br />III. That it shall be the duty of the said Commissioners <br />supervise and compel the opening of the said road and to aupe� <br />tend the making of the same, and that all expenses in the woe. <br />ment of the said line be paid out of the general funds of the county <br />upon the certificate of the Commissioners, and that the said Cis. <br />aioners be allowed ten shillings per day each for each day so em. <br />ployed, and that said Commissioners aliall be indemnified by this Colt, <br />cil and saved harmless h-om any proceedings at law that may arise <br />to them for discharging their duties as aforesaid. <br />IV.
