The Corporation of the County Of Essex By -Lave No. 72 -2012 A By-law to stop up and close a portion of County Road 46 adjacent to Canada Southern Railway, in the Town of Lakeshore. Whereas The Corporation of the County of Essex (Corporation) is the owner of County Road 46 (formerly the King's Highway No. 98); And whereas the Corporation is the registered owner of the parcel of land upon which the former Comber Maintenance Yard was located, which land is located in part of Lot 5, Concession South of Middle Road, in the Town of Lakeshore (formerly the Township of Tilbury West) designated as Part 1 on Reference Plan 12R- 17005; And whereas the Corporation wishes to sell the former Comber Maintenance Yard together with that part of Lot 5, Concession South of Middle Road, in the Town of Lakeshore (formerly the Township of Tilbury West) designated as Part 1 on Reference Plan 12R- 25257, which lands form a small part of County Road 46 (formerly the King's Highway No. 98); And whereas it is necessary to close that portion of County Road 46 designated as Part 1 on Reference Plan 12R -25257 prior to being in a position to offer this land for sale together with Part 1 on Reference Plan 12R- 17005; And whereas by virtue of the provisions of Section 34 of the Municipal Act, 2001, R.S.O. 2001, c. 25, as amended, a by -law permanently closing a highway or any part thereof does not take effect until a certified copy of the by -law is registered in the appropriate Land Registry Office; Now therefore The Council of the Corporation of the County of Essex hereby enacts as follows:. 1. That part of County Road 46, more particularly described as part of Lot 5, Concession South of Middle Road, in the Town of Lakeshore (formerly the Township of Tilbury West), in the County of Essex now designated as Part 1 on Reference Plan 12R -25257 be and the same is hereby stopped up and closed.
