i <br /> i <br /> i <br /> THE CORPORATION OF THE COUNTY OF ESSEX <br /> BY-LAW NUMBER 53-2012 <br /> a <br /> A BY-LAW TO GRANT APPROVAL TO AN <br /> APPLICATION FOR APPROVAL TO <br /> EXPROPRIATE CERTAIN LANDS ALONG <br /> COUNTY ROAD 22 NEAR THE PUCE RIVER IN <br /> THE TOWN OF LAKESHORE. <br /> WHEREAS the Corporation is in a position to begin the reconstruction of <br /> that part of County Road 22 (formerly the King's Highway No. 2) in Phase 5B of <br /> the County Road 22 Capacity and Safety Improvement Program, which <br /> reconstruction includes widening the existing roadway to four lanes, <br /> improvements to the intersection of County Road 22 and County Road 25, and <br /> the rehabilitation of the bridge structure over the Puce River, in the Town of <br /> Lakeshore; <br /> AND WHEREAS it is necessary that the Corporation acquire certain <br /> lands, currently owned by others, along the north and south sides of County <br /> Road 22 to accommodate the reconstruction of this portion of County Road 22, <br /> including the rehabilitation of the bridge over the Puce River; <br /> AND WHEREAS the Corporation made an Application for Approval dated <br /> June 21, 2012 to expropriate certain lands in part of Lots 1 to 6 both inclusive <br /> and part of Block "A", Registered Plan 23, part of Lot 1, Concession East of Puce <br /> River, part of Block 26, Plan 12M-398 and part of Lot 11 in Block °D", Registered <br /> Plan 1517 all in the Town of Lakeshore (formerly the Township of Maidstone), in <br /> the County of Essex, which lands are designated as Parts 1 to 11 both inclusive <br /> on Reference Plan 12R-25124; <br /> AND WHEREAS after the Application for Approval was made on June 21, <br /> 2012, an agreement was reached with the Town of Lakeshore to acquire a <br /> portion of its lands on the west side of County Road 25 designated as Part 11 on <br /> Reference Plan 12R-25124, and therefore this property was removed from the <br /> Application for Approval; <br /> AND WHEREAS to date the Corporation has not been successful in <br /> negotiating a purchase of the remainder of these lands on terms and conditions <br /> satisfactory to the Corporation; <br /> AND WHEREAS no property owner has requested the Attorney General <br /> to appoint an Inquiry Officer to hold a Hearing of Necessity under the <br /> Expropriations Act, R.S.Q. 1990, Chapter E. 26 as amended for any of the lands <br />
