THIS LEASE made in triplicate the 26th day of Mardh A.D. 19 79 <br />BETWEEN: <br />The Corporation of the County of Essex <br />360 Fairview Avenue West <br />Essex, Ontario <br />NOR lE0 hereinafter called "the Lessor" <br />of the First Part <br />AND FARM CREDIT CORPORATION <br />established under the Farm Credit Act, <br />with Head Office at Ottawa, Ontario <br />hereinafter called "the Lessee" <br />of the Second Part <br />WITNESSETH that subject to the covenants and powers implied in the applicable provincial laws and in consideration <br />of the rents, covenants and agreements hereinafter reserved and contained on the part of the Lessee, the Lessor does <br />demise and lease unto the Lessee, its successors and assigns the following premises: <br />Part of the Second Floor <br />Essex County Civic and Education: Centre <br />360 Pairview Avenue West - <br />Essexr Ontario, NOR IZO <br />comprising 700 square feet hereinafter called "the premises ". <br />TO HAVE AND TO HOLD the premises for and during the term of three years to be com- <br />puted from the lot. day of Tune A.D. 19 79 , and from thenceforth next <br />ensuing and fully to be complete and ended. <br />YIELDING AND PAYING therefor unto the Lessor for the term hereby created: <br />the annual rent of S Q r S79, 40 <br />payable in monthly instalments of $ 381.62 <br />each in advance on the 1st day of each month during the term commencing on <br />the 1st day of JUM A.D. 19 79 <br />AND THE LESSOR AND THE LESSEE COVENANT AND AGREE EACH WITH THE OTHER AS FOLLOWS: <br />1. THE LESSEE MAY RENEW the term of this lease for a further term of tloroe Years <br />on the same terms and conditions by notice <br />of intention to renew given to the Lessor personally or by registered mail at least two months prior <br />to the expiration of this lease. <br />2. IF THE PREMISES are at any time during the term of this lease wholly or partially destroyed by fire or <br />otherwise so as to become untenantable, the rent shall forthwith become-payable up to the time of such destruction <br />and the term hereby created shall forthwith terminate, but if the premises are only partially destroyed then the Lessor <br />may with the written consent of the Lessee forthwith repair and make the premises fit for the purposes of the Lessee in <br />which case the term shall not terminate but the rent reserved up to the time of the said destruction shall forthwith be <br />payable by the Lessee and the proportionate part of the rent reserved shall abate until the premises have been made fit <br />for the purposes of the Lessee. <br />3. THE LESSEE COVENANTS WITH THE LESSOR: <br />(a) to pay the rent reserved at the time or times hereinbefore mentioned for the payment thereof without any <br />deduction whatsoever; <br />(b) not to transfer, assign or sublet the said premises or any part thereof without the written consent of the <br />Lessor, which shall not be unreasonably withheld; <br />(c) not to make any alterations or improvements in or about the premises except with the written consent of <br />the Lessor first had and obtained. <br />(d) to leave the premises in good repair, reasonable wear and tear and damage by fire, lightning and tempest <br />only excepted; Provided the Lessee may remove its fixtures. <br />8220 C114 <br />
