BETWEEN: THIS AGREEMENT made in triplicate this 18th day of May, THE CORPORATION OF THE COUNTY OF ESSEX hereinafter called the CORPORATION OF THE FIRST PART; - AND - TOM ~UINLAN & SONS INC. hereinafter called the CONTRACTOR OF THE SECOND PART; WHEREAS the tender submitted by the Contractor for the grounds maintenance at the Corporation's Landfill Site #3 in the Townshi~ of Maidstone was accepted subject to the execution of this Agreement between the parties. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the premises and the covenants hereinafter contained, the Parties hereto agree as follows: 1. The Contractor hereby covenants and agrees to provide and supply at his own expense, all and every kind of labour, machinery, equipment and materials required to maintain the grounds in accordance with the terms of this Agreement and as more specifically defined in the tender documents submitted by the Contractor and accepted by the Corporation all of which are attached hereto and form a part of this Agreement. commencing the __ October, This Agreement shall be in full force and effect ist day of May, ~9__88to and including the 28th day of 3. Payment to the Contractor for the work performed pursuant to the terms of this Agreement and the said tender documents shall be in accordance with the schedule set forth on P~ and ~4 of the tender documents as attached hereto and shall be submitted to the Contractor on a monthly basis in accordance with invoiced billings submitted to the Corporation by the Contractor. 4. The Contractor covenants and agrees to perfom and comply with all terms of the general conditions for grounds maintenance as contained in the tender documents as attached hereto and shall form a part of this Agreement to the same extent as if they were fully embodied herein.
