THE CORPORATION OF THE COUNTY OF ESSEX <br /> BY-LAW NUMBER 11-2012 <br /> A BY-LAW TO ESTABLISH A PROPERTY <br /> TAX REBATE PROGRAM FOR VETERANS <br /> CLUBHOUSES AND LEGION HALLS IN <br /> ESSEX COUNTY <br /> WHEREAS subsection 361 (4) 1 of the Municipal Act 2001, S.O. <br /> 2001, c.25 as amended allows a municipality to have a tax rebate <br /> program under section 361 which provides tax rebates to eligible <br /> charities, organizations that are similar to eligible charities, or a class <br /> of such organizations defined by the municipality, <br /> AND WHEREAS subsection 361 (4) 2 of the Municipal Act 2001, <br /> S.O. 2001, c.25 as amended, allows a municipality to have a tax <br /> rebate program under section 361 which provides for rebates to <br /> eligible charities or similar organizations for taxes on property that is <br /> in any class of real property prescribed under the Assessment Act, <br /> NOW THEREFORE, the Council of the Corporation of the County of <br /> Essex enacts as follows: <br /> 1. In this by-law: <br /> Clubhouse means lands or buildings used as a clubhouse for <br /> veterans of the naval, military or air forces of Canada, Great <br /> Britain or Her Majesty's allies; <br /> Eligible Organization means an organization providing a <br /> Clubhouse, which organization is listed in Column I of Section 2 <br /> hereof; <br /> Taxes mean property taxes for municipal and school purposes <br /> levied for the year on the real property listed in Column II of <br /> Section 2 and payable by the Eligible Organization. <br /> Corporation means a lower tier municipality within the County <br /> of Essex. <br /> Treasurer means the Treasurer of the Corporation in which the <br /> subject property is located. <br />
